Derrick Rose is going to trial for sexual assault accusations from August 2013 where the victim believes she was gang raped by him and his friends.
Derrick Rose is headed to trial for a sexual assault case. Rose submitted a request to have the lawsuit thrown out but was recently denied. According to the U.S. District Court of California record, Rose’s motion to have the lawsuit thrown out was denied because there is, “a genuine dispute of material fact as to the central issue in this action: whether plaintiff consented to sexual intercourse with defendants in early morning of August 27, 2013.”
The case became public when TMZ reported that Rose was being sued by a woman who claimed she dated him between 2011 and 2013. The woman claimed she was “drugged and raped” by Rose and 2 of his friends. She said she was with them when they slipped a drug in her drink. She decided to go home and was Rose and his friends broke into her home and gang raped her. When reports surfaced regarding the incident Rose immediately denied the accusations and assured reporters that he was confident he would be found innocent.
Shortly after the accusations were made Rose filed court documents claiming the woman, “consented to sexual interaction with more than one co-defendant on more than one occasion, consented to sexual interactions on the day in question and invited the defendants to her apartment and buzzed them in.” The woman is seeking $21.5 million in damages. In the beginning it looked like the accusations were absurd and untrue but now the tables have turned. If the case isn’t thrown out than that means that there is enough evidence against Rose that a trial is needed. It looks like its going to come down to his word against her word.
